Selling a Manufactured Home on Its Own Land in Alabama

In Alabama a manufactured home can stay titled like a vehicle, separate from its land, until the title is cancelled. Knowing your home's title status before you list can prevent a closing-day surprise.

This Guide Is General Information, Not Legal or Tax Advice

Wyze Realty is a real estate brokerage. We are not a law firm, CPA, lender or housing counselor, and we cannot tell you what to do about your specific legal, tax or financial situation. Title cancellation goes through an ADOR-appointed designated agent and the county judge of probate; your closing attorney can coordinate, and a probate attorney is needed if an owner has died.

Laws, deadlines and programs change, and the right answer depends on your documents and facts. Nothing here guarantees a result, a price or a timeline. We cite our sources at the bottom so you can check them.

If you own a manufactured home on your own land, the sale can be as simple as any other house, or it can stall at the closing table over one piece of paper. The reason is that Alabama titles manufactured homes much like vehicles. Unless that title has been properly cancelled, the home may still be personal property, separate from the land it sits on. Buyers, lenders and closing attorneys will all want to know which it is.

Why the Title Matters

Alabama titles manufactured homes under the Manufactured Home Certificate of Title Act (Ala. Code 32-20-20 and following). A home with an active certificate of title is generally treated as personal property, like a car, even if it has been sitting on the same land for years. Land, on the other hand, is real property that passes by deed.

When the home is still titled separately, a sale may need both a deed for the land and a title transfer for the home. More importantly, many buyers' lenders want the home to be legally part of the real estate before they will make a traditional mortgage on it. A home that is still titled is usually financed with a personal-property (chattel) loan instead, which can narrow your pool of buyers. Ask any lender what it requires.

Is Your Home Real Property or Personal Property?

Start with these questions:

  • Do you have a certificate of title for the home, or a Certificate of Cancellation from the Alabama Department of Revenue (ADOR)?
  • What is the home's model year? It is usually on the data plate or the title.
  • Is the home permanently affixed: tongue, axles and wheels removed and installed on a permanent foundation system?
  • Are the owners of the home exactly the same people as the owners of the land?
  • Is there a lien on the home's title, such as an old manufactured home loan, and was it released?

If a Certificate of Cancellation was issued, the home is generally treated as part of the real property. If not, read on.

Who Can Cancel (Retire) the Title

According to ADOR, a certificate of origin or title can be cancelled for a manufactured home that:

  • is model year 2000 or newer;
  • is permanently affixed to land, meaning the tongue, axles and wheels have been removed and the home was installed under Alabama Manufactured Housing Commission rules 535-X-12 and 535-X-13; and
  • has identical owners for the home and the land.

How Cancellation Works, Step by Step

The process runs through an ADOR-appointed designated agent, who files through the Alabama Title System. Under Ala. Admin. Code r. 810-5-75-.66:

  1. Find a designated agent. The request must go through an ADOR-appointed designated agent. Your closing attorney or title company can often point you to one.
  2. Sign the Notice of Cancellation (Form MVT 5-39E). The agent prepares it. All owners of the home and the land sign it, and the county judge of probate signs it. The notice is valid for 90 days, so plan the signatures together.
  3. File the Application for Cancellation (Form MVT 5-1E). The agent files one for each home identification number, with the original certificates and any lien releases.
  4. Receive the Certificate of Cancellation. If approved, ADOR issues it. Keep it safe: a lost cancellation certificate cannot be replaced, although records can be obtained from ADOR.

Two details that trip people up:

  • A cancellation certificate can show no more than 2 owners. If more people own the home and land, ask the designated agent or your closing attorney how to proceed.
  • Defective records or no certificate of origin. If title or lien records are defective, or there is no manufacturer's certificate of origin, ADOR may require a surety bond: $50,000 for homes under 10 model years old, or $25,000 for homes 10 or more model years old (Form MVT 10-1A / 10-1).

Homes Older Than Model Year 2000

ADOR's cancellation process applies to homes of model year 2000 or newer. If your home is older, the title cannot be cancelled through this process. Ask a closing attorney or an ADOR designated agent what applies to your home before you list, because it affects how the sale is papered and which buyers can finance it.

Pricing and Selling a Manufactured Home on Land

Buyers look at the land and the home separately in their minds: acreage, road frontage, septic and well or public water, outbuildings, and then the home's age, condition and layout. Homes whose title has been cancelled and that sit on a permanent foundation usually appeal to more buyers, simply because more financing options may be available. A septic system that has been pumped and checked, and a clean survey, also help. See our guides to selling land and septic and other defects.

Some owners prefer to sell as-is, especially for older homes or homes that need work.

If an Owner Has Died

Manufactured homes are often inherited, and that is where title problems pile up. The home may still be titled to a parent who has died while the land passed to a child, or the other way around. Because cancellation requires identical owners and every owner's signature, someone with legal authority usually has to act for the estate first. That often means opening a probate estate so a personal representative can sign. A probate attorney can tell you what is needed. See our inherited house guide and how probate works in Alabama.

What Buyers Usually Ask About

  • Title status. Has the title been cancelled, and can you show the Certificate of Cancellation?
  • Foundation and installation. How is the home set and anchored, and were the tongue, axles and wheels removed?
  • Age and condition. Model year, roof, flooring, plumbing, heating and cooling, and any soft spots in floors.
  • Water and sewer. Public water or well, public sewer or septic, and any septic permits or pump records from the county health department.
  • The land. Acreage, survey, road access, easements and any outbuildings.
  • Additions. Porches, decks or rooms added later, and whether they were permitted.

Having these answers ready, in writing, makes the home easier to finance, easier to insure and easier for buyers to say yes to.

A Typical Timeline

  1. Before listing: find the title or Certificate of Cancellation, confirm owners of the home and land, and find any lien releases.
  2. If the title is still active: contact a designated agent, collect signatures on the Notice of Cancellation within 90 days, and file the application.
  3. If an owner has died: talk to a probate attorney first so someone has authority to sign.
  4. At listing: describe the title status accurately and have the documents ready for buyers and lenders.
  5. Under contract: give the closing attorney copies of everything early so any remaining title work does not delay closing.

Common Questions

Is my manufactured home real property or personal property?

If its certificate of title is still active, it is generally treated as personal property. If ADOR issued a Certificate of Cancellation, it is generally treated as part of the real property. Your closing attorney can confirm.

Which manufactured homes can have their title cancelled in Alabama?

According to ADOR, homes of model year 2000 or newer that are permanently affixed to land (tongue, axles and wheels removed and installed under Manufactured Housing Commission rules), where the home and land have identical owners.

Who files the cancellation?

An ADOR-appointed designated agent files it through the Alabama Title System. All owners and the county judge of probate sign the Notice of Cancellation (Form MVT 5-39E), and the agent files Form MVT 5-1E with the original title and lien releases.

How long is the Notice of Cancellation good for?

90 days. Plan to collect all the required signatures within that window.

What if the title is lost or the records are defective?

ADOR may require a surety bond: $50,000 for homes under 10 model years old or $25,000 for homes 10 or more model years old. Ask the designated agent.

Can I cancel the title on a home older than 2000?

Not through ADOR's cancellation process, which covers model year 2000 and newer. Ask a closing attorney or designated agent what applies to an older home.

Why do buyers' lenders care about the title?

Many lenders want the home to be legally part of the real estate before making a traditional mortgage. A home that is still titled is usually financed with a personal-property loan, which can limit buyers. Ask the lender.

I lost my Certificate of Cancellation. Can I get a new one?

ADOR says a lost cancellation certificate cannot be replaced, but records can be obtained from ADOR.
